Terms of Service

By using this website or engaging Agile Reptile Pty Ltd for any service, you agree to these Terms of Service. If you don't agree, please don't use the site or our services.

Agile Reptile provides website design and development, CRM setup and management, invoice and payables automation, AI receptionist and chat services, Google service setup (Business Profile, Local Services Ads, Merchant Center, Analytics, Workspace), and account audit and recovery services. Specific scope, pricing and timelines for each engagement are confirmed in writing (email or a signed proposal) before work begins.

• There is no upfront fee to have your accounts audited.
• If the audit finds no recoverable amounts, you owe us nothing.
• If the audit identifies money owed to you, we will seek your authorisation before pursuing recovery on your behalf. Any refund is directed to you; we invoice a success fee (currently 30% of the recovered amount, unless otherwise agreed in writing) only after the recovery has been received.
• We make no guarantee that any particular audit will identify a recoverable amount.

Fees for websites, CRM, automation and Google services are set out in your proposal or order confirmation. Ongoing services are billed monthly and can be cancelled at any time with 30 days' notice unless a different term is agreed in writing, we don't use lock-in contracts. Late payments may incur interest at a reasonable commercial rate and may result in suspension of services.

Our AI receptionist, website chat and automation tools are designed to reduce missed enquiries and admin, not to guarantee particular outcomes. These systems can make mistakes, and you remain responsible for reviewing bookings, messages and automated communications sent on your behalf. We recommend a human review process for anything business-critical, at least until you're comfortable with the system's performance.

• Providing accurate information needed to deliver a service (e.g. business details, account data for audits)
• Reviewing and approving website copy, automations and AI configuration before go-live
• Keeping login credentials for any systems we set up secure
• Complying with the terms of any third-party platforms we connect on your behalf (e.g. Google, Xero, Meta)

On full payment, you own the final website design, copy and content created specifically for you. We retain ownership of our underlying tools, templates, automations and methodology, and may reuse general techniques and non-confidential learnings across other client work.

To the maximum extent permitted by law, Agile Reptile' liability for any claim arising from our services is limited to the fees paid for the specific service giving rise to the claim. Nothing in these terms excludes any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Either party may terminate an ongoing service with 30 days' written notice, unless a different notice period is agreed in your proposal. We may suspend or terminate services immediately for non-payment or misuse of our systems.

These terms are governed by the laws of Western Australia, Australia, and any disputes are subject to the exclusive jurisdiction of the courts of Western Australia.

We may update these terms from time to time. Continued use of our services after an update constitutes acceptance of the revised terms.
